1. Introductory provisions

These terms and conditions apply to purchases from the online store www.familytrees.cz, operated by PhDr. Denisa Hledíková, MBA, Svátkova 531/6, Praha 5, 150 00, IČO 06397239. Office competent under Section 71 (2) of the Trade Licensing Act: Prague 4 Municipal Authority.

The supplier is PhDr. Denisa Hledíková, MBA with its registered office at PhDr. Denisa Hledíková, MBA, Svátkova 531/6, Praha 5, 150 00, Identification number 06397239, The relevant Office under Section 71 (2) of the Trade Licensing Act: Office of the City District Prague 4. Hereinafter referred to as "Seller". The contractual relationship arises between the Buyer and the Seller of the goods.

The Terms and Conditions form an integral part of the purchase contract and regulate the relations between PhDr. Denisa Hledikova, MBA as the Seller, on the one hand, and the Buyer on the other.

If the contracting party is a Buyer who has the status of a consumer, the relations between the Seller and the Buyer in the e-shop www.familytrees.cz are governed by these Terms and Conditions and mandatory provisions of civil law, in particular, the provisions of Act No. 89/2012 Coll., Civil Code and Act No. 634/1992 Coll., on Consumer Protection, all as amended.

If the Buyer is a non-consumer, the relations between the Seller and the Buyer in the e-shop www.familytrees.cz are governed by these Terms and Conditions and Act No. 513/1991 Coll., The Commercial Code, as amended.

These Terms and Conditions further specify and specify the rights and obligations of the Seller and the Buyer in the framework of obligations arising from the sale of goods in the www.familytrees.cz e-shop.

Definitions

The seller is a person who, during the conclusion and execution of the contract, acts in the course of his business or other business activities. It is a contractor who, directly or through other contractors, supplies products or services to buyers.

The customer of the www.familytrees.cz e-shop is the Buyer. According to the applicable legislation, a distinction is made between a Buyer who is a consumer and a Buyer who is not a consumer.

A Buyer is a consumer who, during the conclusion and performance of the contract, does not act in relation to his business or other business activity. It is a natural person who buys products or uses services for a purpose other than doing business with those products or services.

A non-consumer Buyer (hereinafter referred to as a "buyer, not a consumer") is a person who, in concluding and performing the contract, acts in the course of his business or other businesses and who buys products or uses services for the purpose of doing business with those products or services.

2. Order and conclusion of the purchase contract

All orders placed through the www.familytrees.cz e-shop are binding according to the provisions of these Terms and Conditions. By placing an order, the Buyer confirms that he has read and agrees with these Terms and Conditions as well as the Complaints Procedure.

The order is a proposal to conclude a purchase contract. Confirmation of the order by the Seller is an acceptance of the proposal. The Purchase Contract is established at the moment of confirmation of the order by the Seller via e-mail or by phone at the Infoline. Orders shipped on Saturdays, Sundays or public holidays will be processed the following business day.

The validity of the electronic order is subject to the completion of all the required data and particulars and a declaration of consent to these Terms and Conditions. Order forms that are filled in incorrectly or incompletely may be considered by the Seller as an invalid order and will not be considered as a proposal to conclude a Purchase Agreement.

The place of delivery of the goods is the address stated by the Buyer in the registration form, the order or given during a telephone call on the Infoline.

If the price of the offered product and its stock availability stated in the order confirmation by the Seller do not match the data stated in the internet offer of the Seller and the subsequent order of the Buyer, the order confirmation by the Seller is not considered acceptance but a new proposal to conclude the Purchase Agreement. In this case, the Buyer has the right to cancel his order. If the Buyer fails to do so within 24 hours of receipt of the order confirmation, it is implicitly deemed that the Buyer agrees with the new proposal for the conclusion of the contract and this constitutes a Purchase Contract.

The ownership title to the goods shall pass to the Buyer at the moment of full payment of the purchase price.

The buyer always has the opportunity to check the order before completing the order. When the order is confirmed by the Seller, the Buyer is always informed of the total and final amount to be paid.

The contract is concluded in the Czech language unless the circumstances on the side of the Seller or the Buyer prevent it, the contract can be concluded in another language understood by the parties.

3. Complaints

Any complaints will be settled in accordance with the Complaints Procedure of the www.familytrees.cz e-shop and in accordance with the law in force in the Czech Republic.

All goods are guaranteed for at least 24 months. The exact length of the warranty period is determined by the manufacturer of the goods separately for each specific item. Warranty conditions, conflict with the purchase contract and the complaint process, rights arising from the warranty, etc., is regulated in detail according to the Complaints Procedure.

4. Withdrawal from the contract by the Buyer who is a consumer,

in the event the Buyer decides to cancel the order for any reason, he/she must immediately inform the Seller (in writing, by email or by telephone) before the goods are dispatched. If there is information regarding the cancellation of the order to the Seller prior to the dispatch of the goods, the Seller is obliged to cancel the order free of charge, thereby withdrawing from the Purchase Agreement.

If the order has already been processed and dispatched, the Buyer (consumer) has the right to return the goods already sent or received within 14 days of their acquisition without providing a reason, in intact condition and intact packaging. Thus, the Seller has the right to withdraw from the concluded Purchase Contract without giving any reasons and without any penalty.

Any discrepancy for goods returned within 14 days (damage, dirt, wear, soiled or otherwise damaged packaging, etc.) The seller will resolve the goods by restoring the goods to the original state before signing the purchase contract. All costs associated with this shall be borne by the Buyer and shall be deducted from the refunded purchase price (in accordance with § 2999 Part 4, Civil Code). The Seller shall inform the Buyer in advance of the costs and shall request the Buyer's approval of the anticipated costs.

The expression of the Buyer's interest in withdrawal from the contract must be delivered to the Seller no later than the 14th day from the day following the day the goods are received. If the Buyer withdraws from the contract, he shall send or hand over the goods received from him/her to the Seller without undue delay, at the latest within 14 days of withdrawal.

The Seller shall return to the Buyer the purchase price already paid to the bank account number specified by the Seller or otherwise by mutual agreement within 14 days of delivery of the withdrawal to the Seller.

At the same time as withdrawal from the contract, the Buyer may send the returned goods to the seller. It must be enclosed with all documents, including the invoice, or the establishment the Purchase Contract must be otherwise credibly proved. Withdrawal from the contract and returned goods shall be sent by the Buyer to the Seller's address.

The possibility of withdrawal does not apply to:

the provision of services if their execution was started with the consent of the Consumer before the expiry of the period of 14 days from receipt of the provision,
the supply of goods or services whose price depends on fluctuations in the financial market beyond the supplier's control
the supply of goods which are personalized to the consumer or for him, as well as perishable, worn or obsolete goods,
the supply of audio and video recordings and computer programs if the consumer has breached their original packaging, the supply of publications, periodicals, and magazines,
software licenses sent by e-mail
consisting of a game or lottery,
to goods showing mechanical or other defects and used goods. Such goods are handled in accordance with the Complaints Procedure and Rules,

5. Withdrawal from the contract by the Buyer who is not a consumer

If the Buyer is not a consumer, the provisions of Section 436 et seq. Act No. 513/1991 Coll., Commercial Code, as amended. The Seller states that the Buyer may be offered an agreement to terminate the Purchase Agreement depending on the condition of the returned goods, the warranty lost and the current value of the returned goods. The condition of the goods shall be evaluated and determined by the Seller.

6. Withdrawal from the contract by the Seller

After confirmation of the order by the Seller, i.e. after the conclusion of the Purchase Contract, the Seller may withdraw from such a contract only if the goods are no longer manufactured or delivered or the price of the goods has changed significantly. In such a case, the Seller shall contact the Buyer and propose a possible solution to the withdrawal. This is usually a recommendation for replacement goods or a refund or overpayment within five business days after the payment is credited to the Buyer's account.

7. Product photo

Photos of products listed on the www.familytrees.cz e-shop, in the catalog and other materials may be illustrative. In cases where the product photos do not match the reality, the photo is marked "This photo is for illustrative purposes only." Some products are constantly evolving and changing, so the available photos of goods may differ from reality (e.g. in design).

8. Consent to the processing of personal data and databases.

The Buyer acknowledges the fact that by concluding the Purchase Agreement with the Seller, it also gives the Seller and the Order Agent the processing of the Buyer's personal data for the purposes of the e-shop database www.familytrees.cz. This database is used solely for the records and needs of the Seller and the Intermediaries, monitoring the processes of order processing, handling the delivery of goods, handling complaints, etc. The customer agrees to use his personal data for delivery, proper billing and possible complaints of ordered goods and sending news via -mail, which can then be rejected.

9. Final provisions

By sending an electronic order, the Buyer accepts without reservation all the provisions of the Terms and Conditions as in force upon the day of sending an order, as well as the price of shipping or postage stated in the catalog of the Internet www.familytrees.cz e-shop. By placing an order, the Buyer is bound according to the provisions of these Terms and Conditions.
These Terms and Conditions and the Complaints Procedure come into effect on 1 December 2017. The Seller reserves the right to change the Terms and Conditions without prior notice.
